Independent Contractor Clause
Independent Contractor Status
Shoreline Journeys Travel LLC is acknowledged as an independent contractor of 58 Stars Travel and the parent consortium of Travel Leaders Network. This relationship is defined by the following terms:
Nature of Relationship:
Shoreline Journeys Travel LLC operates as an independent entity and is not an employee, agent, or partner of 58 Stars Travel. This means that Shoreline Journeys Travel LLC has the autonomy to perform its services without direct supervision or control from 58 Stars Travel.
Liabilities and Responsibilities:
As an independent contractor, Shoreline Journeys Travel LLC is solely responsible for its own actions and any resulting liabilities. 58 Stars Travel shall not be liable for any acts, omissions, or negligence of Shoreline Journeys Travel LLC in the performance of its services.
This clause serves to clarify the independent contractor status of Shoreline Journeys Travel LLC in relation to 58 Stars Travel, ensuring that both parties understand their rights and responsibilities within this professional relationship.
Booking and Payment
**After A Complimentary 15-Minute Phone Call, Please Be Aware That There Will Be A Non-Refundable, Upfront $200 Planning Fee Due Before First Quote For Any Requests Outside Of Sandals & Beaches Resorts** This is because I specialize in Sandals & Beaches Resorts.
- Booking Process: All bookings made via the Site are subject to availability. By booking a service, you agree to pay all applicable fees and charges. All bookings are made directly to the vendor via credit card payment via client. Shoreline Journeys Travel LLC does not keep payment information stored in its system. It is the client’s responsibility to make sure credit card payment remains in good standing. If you do not keep your credit card payment information up-to-date and your reservation gets cancelled, Shoreline Journeys Travel LLC is not responsible for any lost deposits, payments, or cancellation of reservation.
- Payment Terms: Payments must be made using the methods specified on the Site. Full payment or a deposit may be required to confirm your booking, depending on the service.
- Cancellation Policy: Cancellations must be made in accordance with our cancellation policy, which will be provided at the time of booking. Please refer to your booking confirmation for specific cancellation terms.
Client Responsibility In The Booking Process
As a client, it is your responsibility to review all booking details, including pricing, itineraries, and service descriptions, upon confirmation. If you notice any discrepancies or have questions, please contact us immediately to address your concerns.
Travel Insurance And Client Liability
Shoreline Journeys Travel LLC always recommends getting travel insurance to cover the full cost of your trip. If you, as a client, do not wish to purchase travel insurance, you are within your rights. Sandals & Beaches Resorts offers their own travel insurance plan, which can be purchased prior to final payment. I can also recommend other companies for you to purchase insurance for your trip.
I also recommend getting the travel insurance offered by your chosen airline. This insurance will cover flight cancellations as well as flight delays. I also highly suggest contacting your health insurance company to see what coverage you may entitled to outside of the country.
Important Disclaimer: If You Choose Not To Purchase Travel Insurance For Your Vacation
However, by declining travel insurance after being explained the benefits, you are waiving your rights to any legal recourse to Shoreline Journeys Travel LLC in the event of injury, delays, or cancellations at selected destination.
Passport and Travel Document Requirements
Passport Validity
PASSPORT REQUIREMENTS: It is the responsibility of the client to ensure that their passport is valid at the time of booking and for the duration of their travel. Specifically, your passport must remain valid for at least six (6) months beyond your date of departure from the selected destination. This is a common requirement imposed by many countries to ensure that travelers have sufficient time left on their passports to avoid complications during their stay. Passport book MUST be free of damages and it is the responsibility of the client to replace the passport as soon as possible. Passport must have multiple blank pages available as well. Shoreline Journeys Travel LLC is not responsible for denied boarding or entry if client’s passport does not meet requirements. If you have any questions, contact your local passport office.
Shoreline Travels LLC does its best to make sure those requirements are met by requesting a client upload to a secure form a copy of the passport photo page to verify validity. If the passport is not compliant, Shoreline Journeys Travel LLC will direct the client to have that corrected prior to booking to prevent any loss of trip due to invalid identification.
Consequences of Invalid Passport
Failure to meet these passport validity requirements may result in denied boarding by airlines or entry at the destination country. Shoreline Journeys Travel LLC will not be liable for any costs or losses incurred due to your failure to comply with these passport regulations. Examples of potential consequences include:
- Denied Boarding: Airlines may refuse to allow you to board your flight if your passport is not valid for the required duration. This now includes failure to have REAL ID for domestic flights after May 7, 2025.
- Entry Denial: Immigration authorities at your destination may refuse you entry if your passport does not meet validity requirements.
Shoreline Journeys Travel LLC is not responsible for any client who is denied boarding due to conduct deemed unacceptable by the airline, airport authorities, or security personnel. Airlines reserve the right to deny boarding to any client whose personal behavior is deemed disruptive, offensive, or poses a safety concern to crew or fellow passengers. This may include, but is not limited to, intoxication, refusal to comply with crew instructions, verbal or physical altercations, or any conduct that violates airline policies. In such cases, the client will be solely responsible for arranging and covering the cost of any alternative air travel to their destination, as well as any related accommodations or transportation. Shoreline Journeys Travel LLC’s responsibility will be limited to notifying Sandals Resorts or Beaches Resorts of the client’s delayed arrival or inability to attend, as applicable. Any loss of resort days, services, or additional transfer costs resulting from denied boarding will be the sole responsibility of the client and Shoreline Journeys Travel LLC is not responsible for actions by a client that the airlines deemed to be detrimental to a safe flying experience.
Client Responsibility With Regards To Passports And Other Identification Documents
As a client, it is your responsibility to verify the validity of your passport and to renew it if necessary prior to your travel. We recommend checking your passport details at least six (6) months before your scheduled departure to allow ample time for renewal if needed. Additionally, ensure that any other travel documents, such as visas, are also in order to avoid any disruptions to your travel plans.
Shoreline Journeys Travel LLC will advise you of any online digital immigration forms you may have to fill out, but it is the client’s responsibility to complete them prior to travel. Shoreline Journeys LLC is not responsible for denied entry if you, as the client, does not fill out forms in a timely manner as outlined by the destination.
REAL ID Requirements For Domestic Air Travel
If you are traveling within the domestic US, it is your responsibility as of May 7, 2025 to have REAL ID. If you do not have a REAL ID, you will need to carry your valid passport instead. Check your state’s licensing website to understand the REAL ID terms and conditions and how to apply to get one.
By proceeding with your booking, you acknowledge that you have read and understood these passport requirements and accept full responsibility for ensuring compliance. Conduct At Chosen Destination
All destinations reserve the right to take appropriate action, including removal from the property, if a guest’s personal behavior is deemed disruptive, disrespectful, or in violation of resort policies. This may include, but is not limited to, excessive intoxication, inappropriate conduct, harassment, failure to comply with resort rules, or any actions that impact the safety or enjoyment of others. Shoreline Journeys Travel LLC is not responsible for any costs, missed nights, or alternative arrangements should a client be removed from the resort due to their behavior.
In these circumstances, clients are solely responsible for securing and funding their own transportation home or to any onward destination.
Intellectual Property Rights
- Ownership: All content on the Site, including text, graphics, logos, and software, is the property of Shoreline Journeys Travel LLC or its licensors and is protected by copyright and trademark laws.
- Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from any content without our express written permission.
User Contributions
- Responsibility: Any content you post or contribute to the Site (e.g., reviews, comments, photos) is your sole responsibility. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content.

Jurisdiction
Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Lehigh County, PA. This means that if you have any legal claims or disputes with Shoreline Journeys Travel LLC, they must be filed in the specified court within the designated jurisdiction. You agree to submit to the personal jurisdiction of these courts, which means you consent to the court’s authority over you and your legal matters.
Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the issue amicably before resorting to legal action. This may include informal discussions or negotiations. If a resolution cannot be reached, you may then pursue legal remedies in accordance with the governing law and jurisdiction stated above.
Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision will be deemed modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions of these Terms will continue in full force and effect. This means that even if one part of the agreement is deemed invalid, the rest of the Terms will still apply.
Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term or condition, and any failure of Shoreline Journeys Travel LLC to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. This means if we do not enforce a term today, it does not mean we are waiving our right to enforce it in the future.
Entire Agreement
These Terms, along with our Privacy Policy and any other legal notices or agreements published by Shoreline Journeys Travel LLC on the Site, constitute the entire agreement between you and Shoreline Journeys Travel LLC regarding your use of the Site and supersede any prior agreements or understandings, whether written or oral. This establishes that all aspects of our relationship are covered by these Terms, ensuring clarity and preventing misunderstandings.
Errors and Omissions

Right to Correct Errors
In the event that an error is discovered in your booking, pricing, or any other information provided, Shoreline Journeys Travel LLC reserves the right to correct such errors at any time. We will inform you of any such corrections as soon as reasonably possible. For example:
- If a pricing error is identified after you have made a booking, we will notify you and provide you with the corrected pricing. You will then have the option to accept the new price or cancel your booking without penalty.
- If a service description is found to be inaccurate, we will provide the correct details and discuss any necessary adjustments to your booking.
Limitation of Liability
Shoreline Journeys Travel LLC shall not be liable for any damages resulting from errors or omissions, including but not limited to lost profits, indirect, incidental, or consequential damages arising out of or in connection with your use of our Site or services. This limitation applies regardless of the nature of the claim, whether based on warranty, contract, tort, or any other legal theory.

Passport, Visa, and Entry Requirements: It is essential that each traveler possesses a valid passport for the duration of their trip and for at least six (6) months beyond the intended return date. Many countries have specific entry requirements, including visa regulations, vaccinations, and other documentation. While 58 Stars Travel may provide general guidance, it is the sole responsibility of each traveler to verify and obtain all necessary passports, visas, health documents, and other required documentation for their destination(s) prior to departure. 58 Stars Travel can, upon request, provide referrals to professional visa processing services, but any fees associated with these services are the responsibility of the traveler.
Reservations and Payments: A non-refundable deposit is required per passenger to initiate a booking. The specific deposit amount and the final payment due date will be outlined in your individual itinerary. Failure to remit the balance by the specified due date will result in automatic cancellation of the reservation and forfeiture of the deposit. Payment for international airfare is due immediately upon confirmation of the reservation and ticket issuance. All payments must be made in United States Dollars (USD). For Sandals & Beaches Resorts bookings, your deposit is refundable prior to final payment date.
Reservation Amendments: Any modifications to your booking are subject to availability and may incur additional costs imposed by travel suppliers (e.g., airlines, hotels, tour operators). These costs, along with any applicable amendment fees from 58 Stars Travel, will be the responsibility of the client. Approved amendments will also remain subject to the original cancellation penalties outlined below.
Travel Supplier Agreements: In arranging your travel, 58 Stars Travel acts as your agent and may be required to enter into agreements with various travel suppliers on your behalf. By making a booking and any subsequent payments, you authorize 58 Stars Travel to sign these agreements as your agent, and you acknowledge that you will be bound by the terms and conditions set forth by each individual travel supplier. It is your responsibility to review and understand the terms and conditions of each travel supplier relevant to your booking. Please request any clarification regarding these terms from your 58 Stars Travel advisor prior to final payment.
Cancellations and Penalties: Cancellation policies and any applicable penalties vary depending on the specific travel supplier (e.g., airlines, hotels, tour operators) and the type of booking made. The cancellation terms and conditions of each supplier will be provided to you at the time of booking or upon request. Please review these carefully. In addition to any supplier-imposed penalties, 58 Stars Travel has a separate cancellation fee to compensate for our time and services, as disclosed to you.
Refunds: Refunds, if applicable, are subject to the policies of the individual travel suppliers. Many travel components, such as certain airfares, accommodations, and tours, may be non-refundable. If your booking includes non-refundable elements, you will not be entitled to a refund for those components, regardless of the reason for cancellation. Please inquire about the refundability of specific travel components prior to booking.
Travel Insurance: We strongly recommend that you purchase comprehensive travel insurance to protect your investment against unforeseen circumstances such as trip cancellation or interruption, baggage loss or delay, accidents, medical emergencies, and other potential issues. We can provide you with a quote from a reputable travel insurance provider that offers 24/7 emergency assistance worldwide. Please note that coverage for pre-existing medical conditions and supplier financial default may have specific enrollment deadlines (e.g., within 14 days of your initial deposit) as per the insurance policy terms. It is your responsibility to understand the full terms and conditions of any travel insurance policy you purchase. Contact your 58 Stars Travel advisor for a brochure and quote or feel free to purchase insurance from any provider of your choice.
Travel Cost: The total cost of your travel arrangements is based on the features outlined in your itinerary and reflects current costs and exchange rates at the time of booking. While we strive to maintain pricing, significant fluctuations in exchange rates (exceeding 1% from the time of deposit to final payment) may necessitate a price adjustment, for which the client will be responsible. Similarly, any substantial increases in supplier costs beyond our control will be passed on to the client. Such cost increases do not constitute grounds for a refund.
Airfares: Airline tickets are subject to availability and pricing changes until they are ticketed. 58 Stars Travel is not liable for any airline-initiated schedule changes, cancellations, overbooking, or loss/damage to baggage or personal belongings. Any claims related to airline services must be directed to the respective airline. Schedule changes may require additional nights or other alterations to your itinerary, and any associated costs will be your responsibility. It is crucial that the full name on your airline reservation exactly matches your passport. Name changes after the initial booking period (typically 24 hours after purchase or issuance, whichever is earlier) may incur significant airline fees, which will be borne by the client.
Responsibility: 58 Stars Travel, its owners, agents, and employees act solely as agents for the client in arranging travel services, including but not limited to accommodations, transportation, tours, and activities. These services are provided by independent third-party suppliers who are not owned, managed, or controlled by 58 Stars Travel. Therefore, 58 Stars Travel shall not be held liable for any injury, death, loss, damage, accident, delay, irregularity, inconvenience, or additional expenses arising directly or indirectly from: (a) the acts or omissions of any travel supplier; (b) any defect in or failure of any vehicle, equipment, or service; (c) acts of war, insurrection, civil unrest, government restrictions, military action, pandemic, quarantine, strikes, weather events, illness, theft, force majeure, or acts of God; (d) the actions of wild animals; (e) the failure of any means of conveyance to operate as scheduled; (f) overbooking; (g) travel advisories; or (h) any other circumstances beyond our direct control. All such losses and expenses are the sole responsibility of the client. 58 Stars Travel is not responsible for any loss or damage to luggage or personal belongings at any point during your travel. By submitting a deposit, you acknowledge and agree to these terms and conditions. 58 Stars Travel reserves the right to accept or refuse any booking for any reason without discrimination based on race, religion, sex, sexual orientation, gender identity, or nationality.
Future Trip Credits: 58 Stars Travel does not possess special knowledge regarding the financial stability of any travel supplier. While we will relay any information provided by suppliers regarding future trip credits, we are not responsible for a supplier’s failure to honor such credits due to financial difficulties or insolvency, whether a refund was initially available or offered in lieu of a refund. Any future trip credits issued by suppliers are subject to the supplier’s terms and conditions.
Credit Card Chargebacks: 58 Stars Travel acts as a facilitator for your travel bookings, collecting payments on behalf of travel suppliers and remitting those funds accordingly. In the event of an issue with your travel arrangements, your primary recourse is against the direct travel supplier. Therefore, you agree not to initiate a chargeback against 58 Stars Travel for matters within the supplier’s control.
Minor Travelers: Any traveler under the age of 18 must provide written consent from a parent or legal guardian (via letter or email to the travel advisor) prior to travel. 58 Stars Travel assumes no responsibility for the supervision or well-being of minor travelers in the absence of their parent or legal guardian.
Airline Responsibility: The liability of any airline is governed by the terms and conditions outlined in the passenger’s ticket, applicable tariffs, and international conventions such as the Warsaw Convention. Airlines are not responsible for events occurring while passengers are not on board their aircraft. The passenger ticket constitutes the sole agreement between the passenger and the airline. 58 Stars Travel is not responsible for any additional expenses (e.g., hotel nights, meals, transportation) incurred due to airline schedule changes or overbooking that are not explicitly included in your itinerary.
Indemnification: You agree to defend, indemnify, and hold harmless 58 Stars Travel, its owners, agents, and employees from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your travel arrangements or your breach of these Terms and Conditions.
Severability. If any provision of this Waiver is for any reason declared to be invalid or unenforceable, the validity and enforceability of the remaining provisions will not be affected. The invalid or unenforceable provision will be deemed modified to the extent necessary to render it valid and enforceable, and if no modification may render it valid and enforceable, this Waiver will be construed as if not containing such provision.
Governing Law and Venue; Binding Effect. This Waiver shall be governed in all respects by the laws of Washington State without regard to conflict of law principles, with venue in King County, Washington.
Dispute Resolution: Any disputes or claims arising from this Agreement shall first be addressed through good-faith negotiation between the parties. If negotiation fails, the parties agree to submit the dispute to mediation in King County, Washington, with a mutually agreed-upon mediator. If mediation is unsuccessful, the dispute shall be resolved through binding arbitration administered by a recognized Alternative Dispute Resolution (ADR) provider in King County, Washington, in accordance with their rules. The arbitrator’s decision shall be final and enforceable in any court of competent jurisdiction. The parties agree to participate in arbitration proceedings electronically (via telephone or live video) if necessary. Unless otherwise agreed or determined by the mediator or arbitrator, the prevailing party in any arbitration shall be entitled to recover its reasonable attorneys’ fees and costs.
